The case was brought to the king’s attention by a learned Irish monk who claimed one of his students had copied his manuscript without permission and without payment of a fee. After considering all the evidence the king ruled in favor of the monk with this classic pronouncement, "To every cow it’s calf, and to every book it’s copy." A few years ago a well know author told me that the cheapest way to prove copyright was to mail a sealed package to oneself, and in the event of an infringement, produce the unopened post office dated envelope in court as evidence of your prior claim. Unfortunately, it is not that easy. Picture this scenario in which a street-smart lawyer acting for the other side is questioning you as copyright holder: Lawyer: "Would it be possible for you to mail yourself an empty unsealed envelope with more stamps than are necessary affixed to it? Answer yes or no?" Copyright holder: "Yes it is possible, I suppose." Lawyer: "And would it be possible for you or anyone else to then insert printed material inside this envelope, seal it, sign across the sealed flap; tape the flap and indeed all joints on this envelope; and then affix "Scotch" tape or similar transparent sticky tape across all seals and joints; and present it as evidence of a dated unopened envelope? Answer yes or no?" Copyright holder: "Yes but that’s not what I did." Lawyer: "Your honor, since the envelope in question is presented as proof and since it must now be clear that it is not proof, I move that the case be dismissed and that my client be awarded court costs and punitive damages." When authors put the copyright symbol (c) followed by the word "Copyright" and the year plus, the name of the person or organization owning the copyright, plus the words, "All Rights Reserved", after their work, this merely serves as a warning not to copy without first obtaining permission. But, even without this warning, the author’s way of expressing himself or herself is still protected by the copyright law. Author’s wanting to prove ownership of a work with considerable commercial value, can, on payment of a $10 fee, officially register that work with the Register of Copyrights, Copyrights Office, Library of Congress, Washington D.C. 20599, or The Copyright Receipts Office, London, England. Write to either address for an application form. With regard to protecting one’s intellectual property rights, trade marks and Internet Domain names in Cyberspace, it is best to consult a firm of lawyers with the appropriate expertise. According to Tom Lowry, B.A., LL.B, head of the Information Technology Law Department at Herrington and Carmichael, a firm of UK solicitors, "In the USA alone, infringement actions are approaching over 1,000 cases per annum whilst in the UK the number is fast approaching 200 cases per annum." E-mail JohnOC29@aol.com ================================================================ 3) "Dr. Nunley's Biz-Tips" by Kevin Nunley Newspaper Publicity Marcie told me, "I've tried sending out a few press releases to the newspaper, but they never print them." Here's why. Newspaper editors look for press releases that are "newsworthy." Newsworthy simply means that the story is one that lots of readers will find interesting. I asked a newspaper editor what she looked for and here are some of the guidelines she gave: Editors like stories where people overcome adversity or perform acts of kindness. Editors like stories that appeal to a wider audience and transcend your neighborhood or industry. Editors like stories that give the reader some kind of emotion: happy, mad, afraid, proud. Keep in mind that news must be new. An event that happened months ago will not be of interest to the newspaper. Of course, if something new happens that closely relates to an event months ago, the old event could become news again. Don't get discouraged if your first press releases don't get into the paper. Look over them and think what you could do differently next time. Newsworthy-ness is the key. Internet Info More and more small business people are discovering the internet as a wonderful marketing tool. Whereas other forms of big media--like TV and local newspapers--are often too expensive, the Internet is practically free. Juno.com offers a free e-mail account to anyone with a computer and modem. If you've got an e-mail address, tripod.com will give you a free web site. You're business is on the Internet and you haven't spent a dime! You can access your website free at a school or library. Now comes the hard part. With millions of people shouting their messages on the Net, you've got to figure out a way to get prospects to pay attention to you. It's not hard if you keep this simple rule in mind. The Internet is about information. People go on-line to get information. They want it fast. They want it clear. And they want it FREE. In other words, give people quick and helpful information and they'll soon come to think of you as someone to do business with. Cram your website with lots of info. Details about your business. Tips to make the readers life easier, more interesting, and more profitable. Offer a free report with more useful information. Bill Stuffers Ugh! It's invoice time! That anguished cry goes up in most offices at least once a month. Of course, you can also think of sending out invoices as the necessary step to getting paid. That makes all that folding and licking seem not so bad. Also think of sending invoices as a golden opportunity to market your business to your best prospects--people who have already bought from you. If your stamp is going on an envelope that only has a one or two-page invoice in it, you've got room for several more pages. Add a monthly newsletter. It doesn't have to be fancy. Just a simple one-page sheet of info printed out on your computer. Tell customers about new products and services, or how to make better use of ones they already have. George always ads a page of his favorite jokes. Customers, who know George as a jovial guy, don't feel the sting of the bill as much when they have his latest jokes to read. Bring customers back to buy more by adding a coupon along with the invoice. Give them a discount to step up to a higher level product or service. Most businesses feel that repeat business is where the profits are. Marketing With Birthday Cards In the small town where I grew up, there was a woman who miraculously remembered everyone's birthday. It was her hobby to send out dozens of birthday cards every week. She was renowned for it. She was loved for. Mrs. Pepper became one of the town's favorite personalities. Why couldn't a business do the same thing? When someone buys from you, ask "When's your birthday? We'll send you a card." Most people will be caught off guard at your personal touch. Only a die-hard curmudgeon would not feel just a little bit special. (And that's what survey after survey shows--people buy from businesses that make them feel special.) You don't need to make your birthday card project expensive or time consuming. If you have lots of customers to keep track of, keep their birthdays on computer files that can be printed out on labels along with the birthday date. One day each week, pop the week's birthday labels on post cards and send them out. Offer the customer some small free thing. (Don't require a purchase. Birthday gifts aren't supposed to come with strings attached.) Take One Boxes You've seen them in stores. Take-one boxes. It's a little open box with a stack of cards or fliers inside. And it's an excellent (although often over-looked) way to market a business of any size. The average retail outlet has over 2,000 customers passing through each month. This is a remarkable number of people you can reach nearly for free. Find a store or office that relates in some way to your business. Show the manager how your take-ones will be a value to her customers. Most other kinds of advertising suffer from an intrusion factor. People are a little put off by ads in their newspaper, commercials on their radio, junk mail, telemarketing, and unsolicited e-mail. Take-one boxes have none of these problems. It is the prospect's own choice to take one. You've already overcome one of the major obstacles to selling. Keep your take-one items small. A half or one-third page flier is fine. Give your take-one a headline that gets attention and promises a benefit to the reader. Add a drawing or photo to create visual interest. Use colored paper or card stock. Reprint That Ad Ads are great! Not only do they inform customers and prospects about your business, they also lend a little prestige. There's something special about being promoted in the media. When your business is advertised in newspapers, on the radio, or on billboards (just a few examples) it makes your business look bigger and more important. Although most of us would like to plaster the world with our ads, the expense is out of the question. Here's an excellent alternative. When you have an ad run in the paper or on the Internet, make copies to send to prospects, leave on counters, fax to associates, or include in marketing packages. Most publications won't mind that you are making extra use of your ad. Some savvy business owners do the same thing with their radio commercials. You can have a commercial cassette dubbing house make hundreds of inexpensive copies of your radio ad. Pass them around. Here's another variation. Write an article of useful information and get it published in a trade magazine or neighborhood paper. Make copies and include them in all your marketing materials. And often you become a slave to the business instead of gaining more freedom. These are just a few of the problems that come with owning your own business. Now the question is, if you want the freedom and increased income that comes with becoming your own boss, but don't what the headaches that come with owning a business - what do you do? The answer is network marketing. Network marketing is a great way to start your own business without the hassles of government intervention, employee salaries, inventory, it allows you to learn as you grow, and you don't have to worry about whether or not your products or services meet state and federal requirements because the parent company bears that risk so that you don't. Plus, you can often start your business for as little as $5 to $100 or at no cost at all! Also, success in MLM is not limited by ones education level or past employment history. If you've ever been unemployed or had to pound the pavement to find work, you know how frustrating it can be when you're turned down because you've worked for the wrong company or chosen a different career than a prospective employer is looking for. You've probably know that there are many factors that can prevent you from getting hired for a job. Nearly none of them, short of being comatose or dead, apply to MLM. No matter what your circumstances are, MLM can work for you. Some reports show that there are over 800,000 millionaires in the USA and Over 600,000 of them are self-made millionaires. Those reports show that many of them gained their wealth through MLM. Perhaps you're not looking to become a millionaire. Maybe you'd be happy just to settle for an extra $500 a month. Well, MLM is for you too. Of course it's easier and takes less effort to earn $500 per month compared to building a million dollar MLM business, but not much. Your success in a home based business is good for your community too. Just think, the more money you make and have available to reinvest in your community the more the community benefits because you are in a better position to give something back to your community. Your success will benefit many people besides yourself. Traditional MLM has it's problems as well as benefits. Namely, 97% of MLM'ers never earn checks for more than $200. That means if you are operating a full-time MLM business from home, you will likely lose your shirt instead of make a decent living. Why is that true? This is because most pay plans are designed in favor of the company owners, presidents, their moms and other family members who get in early instead of spreading the wealth fairly among everyone. When you look at their fancy pay plans and fancy income grids you see the presidents earnings, not yours. This means that no matter how hard you work or how much money you spend, you will never earn more than $200 with any MLM as long as the company is structured against you, unless you apply "The Six Keys to MLM Success" so that you can make their system work in your favor! Other problems which often prevent most people from succeeding in MLM are: excessively high start-up costs (several hundred to several thousand dollars). They require high priced product purchases, either upfront or monthly. They cost too much to implement their marketing plans. They require too much work for a small return on investment. What I mean is that they may pay .10 commissions for products that cost you $20 to $100 each month. They often have marketing plans that require you to do things you don't want to do. Like speak in public, sell, or make a list of your friends and family. So why do 1% to 3% get rich in MLM despite these odds? Timing, they own the company, they recruit experienced MLM'ers, they join programs that pay well regardless of the size of the downline, and they apply "The Six Keys to MLM Success". You may be wondering, if there are so many problems associated with MLM why do I believe MLM is an outstanding business for the average person. It's because all of the problems of MLM can be avoided by doing two things. First, you must choose an MLM company wisely. You must choose a company that will pay well regardless of the size of your downline. Second, you must apply "The Six Keys to MLM Success". "The Six Keys to MLM Success" will force you into a position where you will be better prepared to succeed with virtually any MLM opportunity you choose to participate in. When a company is new they often offer signing bonuses to heavy- hitters who have name recognition in the MLM industry. This is because when a prominent heavy-hitter joins a MLM program hundreds or thousands of non heavy-hitters will also join just because they heard that "Mr. Successful" or "Mrs. Successful" joined the company. It's in the company's best interest to sign these heavy-hitters. Conversely, it's in the heavy- hitters best interest to join a MLM program when it is brand new. This is because they are often guaranteed the number one or number two position in the company (thereby earning several million dollars just for being in the right place at the right time). There is little you can do to guarantee that you'll be in the right place at the right time, unless of course you wait until a MLM program gains momentum and join right before they go global, or start your own MLM company or join and participate in every new program that comes along. Of course there is tremendous financial risk in joining every program that comes out. That's because there are fewer than 30 companies that have been around five or more years. All the hundreds of small programs (and several larger MLM companies) have gone belly up within three years. That means if you join every program that comes out you risk losing money and risk diluting your credibility. If you join multiple programs people may believe you are insincere about the products and are just in it for your own personal gain and not theirs. It's difficult to pull this off successfully. One heavy-hitter that is effectively marketing several programs at the same time is Linda J. Bruton. This heavy-hitter encourages her downline to participate in a new program each month (on top of the other programs she's encouraged them to participate in). Whether this is right or wrong you will have to decide for yourself. Being the cynical skeptic that I am, I always wonder what's the motive of the person making the suggestion, and I work the numbers to see if what they are telling me is likely to come true or not. For example, I just received a flyer in the mail that said, "Make $31,932 Every Month With Just 2,048 People!" Now really, how many people do you personally know who have that many people in their downline? Most people have absolutely no one in their downlines. That's because 80% of MLM'ers never recruit anyone. That means no matter how many people you recruit, 80% of them will do absolutely nothing. When you do the math with this program you'll figure that means you'd have to find 102,400 people to join your downline just to get 2,048 productive MLM'ers in that program. I tell you, these figures represent the presidents pay plan. Because no matter how well you do or don't do, he's so far a head of you just by owning the company that he's virtually guaranteed to succeed as the plan shows (unless the company goes belly up). Encouraging others to join multiple programs underneath you can be a very effective way for you to market several MLM's at once. Another way is by promising "several paychecks instead of only one". If you've been around MLM for any length of time, you've probably been approached to join a program that pays several commissions by having you join only one MLM "club" or "permanent downline" team. The problem with both of these scenarios is that instead of spending money to market only one MLM program, often you must spend 10 - 12 times as much time and money as you would if you were just promoting one MLM program. If you choose not to participate in the other programs after you join, you may find that the program coordinator will kick you out for being "non-productive" and for not buying into their plan each month. Everything that you've worked for will go down the drain because you chose not to spend even more money in their programs. Please note, just because they say that the program "finances itself" or "pays for itself" doesn't mean it really does. If they don't offer a written guarantee don't join unless you can afford to lose whatever it costs to join. Look for refund guarantees or guarantees that say you will make the kind of money they are saying you will make. Likely the pay plan really is the company owner's pay plan. Their pay plan is an explanation of how well the company president will do when you and everyone in your downline follows their plan as instructed -- regardless of whether or not you make money or lose money. For more about watching out for the president's pay plan read the section, "Join a program that pays well". If you wish to benefit from timing you must keep your eyes and ears open for new companies and new trends in the MLM industry or you must start your own MLM company. Keeping your eyes and ears open or starting your own company is the only way to guarantee that you'll be in the right place at the right time. Knowing that 90% of MLM companies die before reaching three years of age what steps should you take to limit your risks while joining MLM start ups? First of all look for new companies with sizzle products or superior distribution methods or superior products than can be bought locally. Look for companies that offer free enrollment or low start up costs. This way you and everyone you sponsor can limit or totally eliminate taking a financial risk if the company fails within three years or less.
